• Enable AI-powered chat functionality on shared files
• Generate access codes for secure file sharing
• Track when recipients view shared files

3. Account and Registration

To use certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

• Upload, share, or distribute illegal content
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems
• Use the Service for any unlawful purpose
• Resell or redistribute the Service without permission

5. Content and Intellectual Property

Your Content

You retain ownership of all content you upload. By uploading content, you grant us a limited license to store, process, and transmit your content solely to provide the Service.

Our Content

The Service, including its design, features, and documentation, is owned by FileChatSend and protected by intellectual property laws.

AI Processing

When you enable AI chat on your files, we process your content using third-party AI services (such as OpenAI) to provide responses. We do not use your content to train AI models.

6. Pricing and Payment

Some features require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your chosen plan
• Provide accurate billing information
• Authorize recurring charges for subscription plans

Prices may change with 30 days' notice. Refunds are handled according to our refund policy.

7. Free Tier

The free tier allows local file packaging without cloud features. Free tier users must provide their own API keys for AI functionality.

8. Data Retention and Deletion

• Free cloud packages expire after 7 days
• Paid packages are retained according to your plan (30, 90 days, or indefinitely)
• You may delete your content at any time
• Upon account deletion, we will delete your data within 30 days

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-generated responses may contain errors. You are responsible for verifying the accuracy of AI responses before relying on them.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILECHATSEND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FileChatSend from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time through your account settings.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.
